Terms of Service
Effective date: November 03, 2023


These Terms of Service set forth the agreements and conditions between the creator of the commissions, (hereinafter referred to as "the artist") and the party requesting the commissions, (hereinafter referred to as "the client") when soliciting and acquiring digital drawing services.


1. Service Description:
1.1. The artist agrees to create digital illustrations according to the specifications provided by the client during the commission process and according to the agreements stipulated individually by both parties at the time of requesting the service.1.2. Illustrations may include characters, backgrounds or other elements previously agreed between the artist and the client.Exceptionally, orders that include characters that do not belong to the client or that are not owned or authorized to be used by the client as the object of the service will not be accepted.1.3. If the client wishes to request a commission on a character not belonging to him/her, he/she must comply with at least one of the following requirements:- The client has full authorization to request a commission with a character that is not owned by the client (must present visual proof where the actual owner of the character authorizes its use for that purpose).
- The client has recently acquired the character from its original owner or reseller (must present visual proof where the owner or reseller has delivered the acquisition to the client)


2. Commission Process:
2.1. The client should send a detailed request including the description of the assignment (if available also visual references and any other relevant information).2.2. The artist will then analyze the request and may ask the client for additional details. Possible complications that may involve the ownership of the characters, the possibility of successfully completing the assignment, among other issues, will be resolved. After the possible difficulties are resolved, the artist will provide a fixed budget (or variable depending on the type of order, special cases) and an estimated time frame (not necessarily certain or exact) for the completion of the assignment.2.3. Once the client accepts the budget specified by the artist, a down payment of 50% of the total payment will be required before the artist starts working on the commission.2.4. Once the order has been completed, the artist will send it to the client through any social network, app or web page previously agreed upon by both parties and in the format the client requires.


3. Payment and Refund Policy:
3.1. The total commission price will be based on the level of detail, complexity and time required to complete the work (reference in clause 2.2).3.2. The client must make an initial payment of 50% of the total agreed payment before the work begins (reference in clause 2.3).3.3. If the client decides to cancel the commission after the artist has started work, the initial payment will not be refundable. (Exceptional case of refund will occur when the commission has not yet started or there is no initial sketch, the artist is obliged to present at least one proof that he has started the work).3.4. In the event that the artist is incapable of completing the commission due to unforeseen reasons or due to his/her own ability, the initial payment will be refunded in full to the client.


4. Ownership and Use of Artwork:
4.1. The artist will retain the copyright of all artwork created, meaning that the artist during and after the commission process with a client, will retain the copyright of the artwork. In that sense, the client will not be able to publicly or privately claim that the material created by the artist has been created by another person or credit himself for the creation of the illustration.4.2. Client will be granted a license for personal, non-commercial use of the artwork. The client will enjoy full personal use of the artist's artwork, whether as a social media post, profile picture, etc. It will not enjoy commercial use to be resold to third parties or for the client to acquire the intermediation between a final consumer and the artist. It is strictly forbidden to generate money using as a basis the illustrations created by the artist.4.3. The client may resell, redistribute or use the artwork for commercial purposes only if there is express consent (and recorded by any digital or physical means) between both parties.


5. Privacy and Confidentiality:
5.1. Both the artist and the client agree to maintain the confidentiality of any information provided during the commission process within chats of any social network or electronic media unless the information exposed is content related to the development or process of the commission (does not include payment arrangements).5.2. The artist may use the artwork created as part of a client's commission, either for the artist's portfolio or promotion. The artist only may not use such works when the client requests during the process of creating the commission that the work may not be used for such purposes.


6. Client Fraud and Termination of Service
6.1. The client incurs in fraud to the present terms of service when one or more of the following requirements are met:- By deception attempts to persuade the artist to request a commission of which he/she has no power to request.
- By deception he uses falsified or illegitimate evidence to seek an exclusive and unfair advantage.
- By deception attempt to pass off as your property, characters of third parties without any authorization from the current or original owner.
- Fails to make the initial payment or the full payment agreed upon.
- Breaches clauses 1.3, 2.2, 2.3, 3.2, 4.1, 4.2, 4.3 and/or 5.1.6.2. The client who incurs in fraud for one or more of the causes of clause 6.1 could lose the initial payment given to the artist as the case may be, and the commission service will be automatically terminated.


7. Modifications of terms of service
7.1. The artist has the power to modify the terms of service when necessary in order to avoid loopholes that could lead to fraud or unfairness to all parties.7.2. These future modifications will not alter the agreements established before the Terms of Service were modified in order to respect the initial agreement.




By requesting and accepting a commission or service provided by the artist, the client agrees to comply with and abide by these Terms of Service. Any violation of these terms may result in early termination of the service, whether or not as the case may be, with or without refund of the payment made in advance.
